My fight angainst the French Health Ministry and Vivendi, the water provider.


A public health tragedy that struck the inhabitants of this little Guadeloupean dependency in the French West Indies.
It is an example of what is possible (lies, murder attempt, murders) when the Political power (the French Health Ministry) and the Financial power (Vivendi, the water provider) work together to hide a huge Public Health scandal.

I settled in Guadeloupe during August 1991, as Professor of Mathematics at the Faculty of Sciences, Director of the Laboratory "Research Group in Statistics and Applied Mathematics" and Surgeon in the private sector. In August 1995, following the passage of two cyclones, the water supply pipe on the island of Désirade (small dependency of Guadeloupe) was damaged.

When the adduction pipe was repaired three weeks later, a serious public health problem appeared on the island. As I was the correspondent of the doctor of the island, Dr. Jean-Marie Le Cabellec, I was mixed despite myself to this dramatic case, reported in the site :

The calls of Dr. Le Cabellec and myself, to the DDASS, were in vain during the nine months that lasted this crisis. Indeed, the DDASS and the Prefecture of Guadeloupe, had for only concern, that nobody questions the quality of the water distributed by the Generale des Eaux, that became then Vivendi Universal and then Veolia.

The crisis came to an abrupt end in June 1996, when the island doctor asked people not to drink tap water. On August 12, 1996, Dr. Le Cabellec was stabbed (dagger 40 cm long, having passed through his chest and the upper part of the abdomen). The Police, after a few hours of investigation, concluded to a "suicide attempt for advertising purposes, to defend its cause: water". This absurd statement was rejected by the medical examiner consulted.

Facing with the scandalous behavior of the Health Authorities and the "pseudo suicide attempt" of Dr. Le Cabellec, I wrote a very violent article against the DDASS, in a local newspaper. The latter sued me in court:

  • For defamation: before the overwhelming evidence that I provided, she backed down
  • For violence resulting in mutilations and permanent infirmities: before the absurdity of the accusation, I easily obtained a dismissal.

Meanwhile, in Paris, I sued the newspaper Le Figaro for defamation, following the publication of the official version of the Sanitary Authorities ("Collective psychosis fomented by the doctor of the island and the surgeon"). Le Figaro was sentenced in first instance and on appeal. This judgment constitutes a final conviction of the DDASS Guadeloupe in this case as well as the Prefecture of Guadeloupe and the Ministry of Health.

In front of my obstinacy to defend the inhabitants of the Desirade and its incapacity to make be condemned, the DDASS, asked by mail to the Social Security to control me.
Thus, Social Security has brought a doctor inspector from Paris, Dr. Gay who has assembled a file from scratch, choosing from the patients' files, that the elements that were against me (like a normal ultrasound of a vesicle) and leaving aside the elements that gave me the exact right (like the histology of the said vesicle).

Thus, I was sued before the Sections of Social Insurance of the Councils of the Order of Doctors. After multiple appeals, I was finally sentenced to one year (the year 2006) of "prohibition to give care to the insured persons". I must say that Dr. Gay is a general practitioner and therefore she does not know anything about surgery. After her exploit, she was quickly called to much more important functions.

Just a word about the Social Insurance Section of the Councils of the Order of Physicians: it is an amazing institution, set up by the Ministry of Health, with the complicity of the Ordre des Medecins (Medical Council). It is the Social Security that prosecutes doctors who displease her and it is she who appoints half of the doctors judges. This allows Social Security to have them convicted without any problem. Let's add to this, that the members of this commission have no obligation to know anything about the specialty of the doctor they "judge". And the most extraordinary fact is that the Social Security and the Ordre des Medecins, say without laughing, that this body "respects the rights of man and the citizen".

Feeling threatened, I preferred to leave Guadeloupe quickly in August 1999, which ruined me. I never recovered from this situation.

For my own part, I do not regret anything, and if I had to do it again, I would do exactly the same thing.
